Privacy Policy

Whereas Capital Apdaila (hereinafter referred to as “Capital”, “we”, “us”, “our”) values your privacy, we have developed our privacy policy that describes in detail what personal and other information about you the company collects, how this information is used and shared, what your rights are regarding the use and disclosure of your personal information to other parties.

Capital collects information on the website capital.lt and any other website where this Privacy Policy is published (including sub-areas and mobile versions of each area hereinafter referred to as “Site” and collectively “Sites”).

Except as otherwise discussed in this Privacy Policy, this document regulates only the use and disclosure of information that we collect from you through our Sites. Before disclosing your personal information to others, please familiarize yourself with this Privacy Policy and those of third-party websites.

Information that we collect

Capital collects your personal information when you use our services as described below. The term “Personal Information” refers to any personally identifiable information, such as name, telephone number, email address, postal address, that is used alone or in combination with other personal or personally identifiable information and that is or may be associated with a specific person. Capital collects Personal Information and other data from you and uses that information in the way set forth in this Privacy Policy or in another way that has been communicated to you (and for which your consent has been obtained, if required by applicable law).

When you register or log in to use our services

You can register on our Sites in several ways: (1) you can fill out the registration form yourself; or (2) it can be done by one of our employees upon your consent after you have applied for our services. 

If you have registered to use our services, we will collect the following Personal Information from you: your name, surname, email address, username, password, as well as other Personal Information that you provide when filling out the registration form. If you prefer, you can provide us your phone number and postal code. We will use the Personal Information we collect to provide you with requested data, to manage your account, to respond to your inquiries, to send information and newsletters related to the real estate market and/or other information that we believe will be of interest to you and others, as well as for other purposes described in this Privacy Policy.

Newsletters, inquiries and emails

You may subscribe to our newsletters and/or different other communications that contain information about Capital, Capital’s franchisees owned and operated by various owners, independent real estate sales associates, real estate, user manuals and information, as well as other topics or offers that may be interesting to you about us and related legal entities or about our advertisers, sponsors, and other business partners. You can order and receive information about a real estate item from a specific agent or office or you can join our general mailing list. If you have submitted an inquiry for a specific real estate item, you may be contacted by an independent Capital real estate sales associate regarding your inquiry or other relevant property. In addition, if you indicate that this real estate item is one of your “favourites”, the system may automatically add you to the list of recipients that receive email updates about this real estate item (these emails will be sent to you by an independent agent of a franchisee’s real estate sales; in order to capitally opt out of these emails, click on the opt-out link in each email, or contact us at info@capitalrealty.com.

Please note that if you choose to provide your email address or other contact information to an independent Capital real estate sales associate, we will share your information with that company. However, we have no control over the use of this information by these independent real estate associates or the offices of Capital’s franchisees owned and operated by various owners, and therefore this Privacy Policy does not apply to the actions of third parties related to their use of your Personal Information. To learn more about their privacy protection practices, please contact a specific associate or office directly, or use the links provided in communications you receive from that entity.

Contests and totalisators

We may run or advertise contests or totalisators through our services. To participate in our contests or totalisators, you need to register by email info@capitalrealty.com. When you register, we will collect the following Personal Information: your name, surname, address, phone number and other information that you provide in the registration form.  

Please note that the privacy policy applicable to specific contests or totalisators may differ from this Privacy Policy in cases where the contest or totalisator is sponsored by a third party and hosted on their site. If the privacy policy applicable to the terms of a contest or totalisator differs from or conflicts with this Privacy Policy, the privacy protection practices of the contest or totalisator in which you are participating apply and are to be set forth in the rules of that promotion event. 

Without limiting the foregoing, we or a third party may use your Personal Information to contact you and to notify you of a winner, or to confirm information about a prize delivery.  Upon your written consent, you may be added to the list of recipients of e-mails/SMS messages from us and/or our advertising partners associated with contests or totalisators. 

If you win a contest or sweepstakes, upon your consent we will publicly publish some of your information on the winner’s page/Sites and/or other means of public information.

In some cases, a third party, such as an advertiser or sponsor, may run or host a contest or totalisator on their site for our services (or promoted by our services) and may collect your information. In such cases, if we are not the sponsor, operator or organizer of the contest or totalisator, we have no control over the information collected, so we encourage you to review the official rules of the contest/totalisator and the privacy policy of the promoter or sponsor applicable to that contest or sweepstakes before participating.

IP addresses and data of visited pages

When you visit our Sites, the Sites and servers collect the following information from you: your IP address, the pages you visit, and the content of our Sites you view. The information collected in such way is not used to identify you personally. However, if you have registered on the Sites, we may associate certain information with information that identifies you. Information collected on our Sites includes information automatically sent to us by your Internet browser: this is information about your operating system, the address of the website you visit when you open our Sites, the date and time of your visit, the browser you use and the structure of Internet data traffic, as well as information about what content you have viewed on our Sites.

Cookies, web beacons and other tracking technologies

Our Sites use cookies, which are small, commonly used files that we or third parties transfer to your computer after you allow your browser to accept them. We or our third-party service providers/advertisers may also use “web beacons”, “screen element tags” or other tracking technologies, which are typically small pieces of a code on a web page that monitor the behaviour of our visitors and collect data about their actions online.

These cookies and other technologies may be used to track time and sites. For example, using these technologies we can analyse the structure of your Internet data traffic, optimise your experience using our Sites, store information during your session, personalise the Sites based on your preferences and options, target you with advertising or content (as described below), and collect information about your visit on our Sites. You may adjust your privacy settings by adjusting the use of cookies and similar technologies in your browser; however, if you disable cookies, some features of our Sites may be affected and/or may not work.

If you contact us from our Sites

You may ask us questions about our services, business, etc. Any information you provide while visiting the Sites, including name, surname, telephone and residential information, will be used only to process your request or respond to your inquiry, or to provide additional information related to this inquiry. Upon your consent, we may add you to our marketing list for information associated with your inquiry or information that we believe would be of interest to you in other respects. 

To whom and for what purpose the information is transferred

The Personal Information we collect about you may be transferred to various parties, depending on the purpose for which it is collected and the context in which it is provided. If you are looking for a real estate item, we will direct you to the office site of Capital’s franchisees owned and operated by various owners and forward to them the information you have provided to us, including your search parameters; and if you have registered, we may share your contact information with this office. If you wish to contact a Capital agent or office, we will disclose the Personal Information you have provided to these parties in order to fulfil your request. 

We may also transfer your Personal Information to third parties for marketing, advertising or other commercial purposes upon your written consent. 

You may also request information associated with third parties that are not subsidiaries or franchisees of Capital or our Associates (for example, banks, mortgage broker partners, sponsors or service providers or one of our partners). If you wish to receive information from such third party or wish to be contacted by such third party, we will transfer your Personal Information to them.

Depersonalised information. We may share with current or potential advertisers or business partners the analysis of our server inputs, data traffic information or information associated with potential clients, including data about the use of our Sites and general information about our visitors. The information made public in this way usually includes the usage-related data and other information selected from this analysis data, which are not considered Personal Information.

Merger and acquisition. When we are subject to a commercial transaction, such as a merger, acquisition, liquidation or sale of all or part of our assets, in most cases Personal Information becomes part of the transferred assets or may be disclosed (subject to confidentiality restrictions) during a complex legal evaluation. After such transfer of assets, the acquiring company will be required to use your Personal Information in accordance with this Privacy Policy and the privacy settings you choose.

Site service providers. We may transfer Personal Information and other data to service providers who provide specific services on our behalf without your consent or in other circumstances listed below. For example, we may forward certain Personal Information we collect to third parties such as online data submission or processing providers, payment operators or other service providers. 

Disclosure of information in accordance with legislation requirements. We may, without your consent, obtain and disclose your Personal Information, communications sent or received by you, and other information that is permitted to be disclosed or that we reasonably believe is required to be disclosed pursuant to laws, regulations, rules, a court order, a subpoena or other legal request received from governmental, regulatory (control) or administrative bodies or law enforcement authorities (including disclosure of information in response to law enforcement or national security requirements), as well as in response to claims/lawsuits or to prevent or investigate violations of our Terms of Service, as well as identifying individuals or organizations that may be involved or taking certain actions related to suspected fraud, violations of our Terms of Service or activity that we believe is illegal or that we believe may subject us to legal liability. In addition, we may disclose Personal Information in extreme cases where, in our view, there is a potential risk to the physical safety of a person or property, if we believe that your information is in any way related to that risk.

If you contact us using social media

When you visit Capital's social media accounts (Facebook, Instagram, LinkedIn) (including messages, use of the “Like” and “Follow” boxes, and other communications), your Personal Information is controlled by the manager of the social media. Capital recommends to read the privacy policies of third parties and contact the service providers directly if you have any questions.

How we use information

We use the collected information to provide high quality services and improve their quality. The collected information is used for the following purposes:

To communicate and present our products or services in the market, as well as to communicate and present the products and services of Capital’s network franchisees owned and operated by various owners, i. e. offices and associated independent real estate agents;

To solve problems;

To respond to questions or inquiries regarding the provision of services and monitor these responses;

To manage our services and evaluate their use;

To inform you about offers or new features that we think you would be interested in;

To optimize or personalize your experience when using our services;

To provide the information or services you request;

To help you participate in various programs, promotions or contests;

To manage your subscription to newsletters or ensure your presence on the subscriber list;

To direct advertising or content or use for other advertising or marketing purposes;

To explore the usage and popularity of different areas of our services and to improve our services;

To examine the general distribution of the locations where our content is viewed (by looking at IP addresses). We may also use this information for other purposes related to our and our company businesses, as well as for other purposes set forth in this Privacy Policy or in any other agreement/contract you may enter into with Capital, or as otherwise notified to you by us (and we will obtain your consent).

Your rights

You have the right to limit or opt-out of e-mails we send. You may unsubscribe from e-mails by clicking on the unsubscribe link in each e-mail. You can get more information about the opportunity to unsubscribe from e-mails by contacting us by email info@capitalrealty.com.

You may obtain or update any Personal Information contained in your profile by logging into your account and updating your profile. If you have problems or need more information, contact us by filling out the appropriate “Contact us” form. We will respond to your requests to access or review the information and provide such access as is necessary or permitted by laws. We may decide not to grant access or not to permit viewing information if, in cases provided for by laws, it is necessary to ensure the prevention, investigation and detection of crimes, violations of official or professional ethics, and the protection of the rights and freedoms of other persons.

You can delete your account by contacting Capital by email info@capitalrealty.com. You may also ask Capital to delete all Personal Information they hold about you. You must submit this request in writing and send by e-mail info@capitalrealty.com. Please note that if you have requested to delete all of your Personal Information, you will no longer have access to your existing Capital account and will no longer be able to use any Capital products and services. Capital reserves the right to retain certain account information for record keeping purposes.

You are also entitled to exercise other rights granted to you as a data subject by laws in relation to the collection, processing and storage of your Personal Information.

Links and referrals to third-party services

The Services contain links that may direct you to Third-Party Services (as defined in our Terms of Service). Capital does not control the Third-Party Services, and Capital is not responsible for the data privacy or security practices of those Third-Party Services or for how they may use the information you provide. Please note that when you use a Third-Party Service, any information you provide, including financial information, is subject to the terms of use and privacy policy of that site or service.

Information protection and its retention period

In order to protect your Personal Information, we have implemented reliable security measures designed to protect the Personal Information you provide, and we arrange work procedures to ensure the safe handling and transfer (if present) of computer data and/or documents and their archives. 

Capital stores your Personal Information no longer than is necessary to achieve the purposes for which Your Personal Information has been collected, as specified in this Privacy Policy. In all cases, your Personal Information is not stored for longer than 3 years, except in cases where the information needs to be stored longer according to legislation. At the end of the storage period for your Personal Information, your Personal Information is destroyed/deleted in such a way that it cannot be recovered. 

Validity and amendments of Privacy Policy

Each time you use the services, the current (relevant) version of the Privacy Policy is applied. Therefore, when you use the Services, you should check the effective date of this Privacy Policy (it is indicated at the beginning of the Privacy Policy at the top of this document) and review the amendments that have been implemented since the last revision. We reserve the right to change this Privacy Policy at any time and without notice, just by posting the necessary amendments. Such amendments are effective immediately upon posting them with the services.

Disclaimer

Capital aims to ensure the security of your Personal Information and takes all necessary measures for this purpose; nevertheless, Capital will not be held liable for any damage and/or loss caused to you and/or third parties as a result of your provision of incorrect and/or incomplete personal data and your failure to inform about their change in time. In addition, while Capital takes all reasonable measures to prevent unauthorized use of your Personal Information by third parties (companies), Capital will not be held liable for any violations, losses or damages arising from the use/misuse of your Personal Information collected by those third parties. 

Dispute resolution procedure

Disputes regarding the improper execution or non-execution of the contract are considered outside the court in accordance with the procedure established by the Law on the Protection of Consumer Rights of the Republic of Lithuania at the State Consumer Rights Protection Service, address: Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, phone: (8 5) 262 67 51, website: www.vvtat.lt. International visitors

By accessing our services outside of Lithuania, you consent that your information is transferred to Lithuania and processed, used and distributed in accordance with this Privacy Policy. In addition, if you use access to a link to Capital’s international website to search for real estate items in other countries, your information may be transferred to or processed in other countries. By accessing the link to Capital’s international website, you consent to the transfer and processing of your Personal Information as described above. Regardless of where your information is collected or transmitted, it will be handled in accordance with this Privacy Policy.
